Oops: After Threatening Hacker With 440 Years, Prosecutors Settle for a Misdemeanor | WIRED.

Read the linked article, and then come on back here. I’ll wait.

A friend of mine commented the following on his facebook page.

We fear what we don’t understand – that part I get. But when we legislate and prosecute out of fear, we undermine the very causes for which we’re fighting. I work in IT, and I dislike crackers and malicious hackers just as most people do. So let’s aim more of our prosecutorial power at the people who are the *REAL* threats – the ones stealing credit cards, dealing in online child porn, etc. Going after this guy – and throwing half a millenium of potential jail time at him – was simply a waste of resources and a demonstration of poor judgment.

I would consider this friend an IT guru. He mentored me a few jobs back and if I ever have an issue I know I can go to him and get an answer.  I have no idea of his political stance, and I’m okay with that. I thought what he said was rather interesting though, particularly  if you turn it to 2nd amendment rights.  If you change up what he said, slightly, in order to reference firearms, then you start to begin to understand why 2nd amendment advocates despise groups like Moms Demand Action, and Bloomberg’s latest hate group.

Allow me to demonstrate;

We fear what we don’t understand – that part I get. But when we legislate and prosecute out of fear, we undermine the very causes for which we’re fighting. I own guns, and I dislike criminals and murderers just as most people do. So let’s aim more of our prosecutorial power at the people who are the *REAL* threats – the ones raping women, assaulting children, etc. Going after the woman arrested in New Jersey – and throwing half a century of potential jail time at her – was simply a waste of resources and a demonstration of poor judgment.

You can use a myriad of different examples for the prosecuted individual here. I chose the example of Shaneen Allen, but it could be just as easy to add any number of gun enthusiasts caught up by crap laws.

“Common Sense” gun legislation has nothing to do with common sense, and my friend accidentally hit the nail on the head on a completely unrelated subject.  “When we legislate and prosecute out of fear…”  That’s the problem. In Massachusetts, Colorado, California, Washington, Nevada, Maryland…, they have legislated out of fear, and not on any rational basis, or facts.  In order to justify their stance, the legislators then perpetuate that fear, through bullshit facts and made up statistics.  They have created a new class of criminal to locate and prosecute, who only days before the law passed, were perfectly peaceful law abiding citizens.

So for groups like the Coalition to Stop Gun Violence, Moms Demand Action, Everytown for Gun Safety, etc., please note that these are some of the people my friend is inadvertently talking about.  These are some of the ones who are trying to legislate and prosecute out of fear, and ignorance.
